Custom Order Terms & Conditions
By placing a custom order with Stitch with Attitude, you (“Customer”) agree to the following terms:
1. License & Usage
- If Stitch with Attitude creates a custom design at the Customer’s request, all intellectual property rights in the final design, including modifications or improvements, will remain the sole property of Stitch with Attitude, unless otherwise agreed in writing.
- If the Customer provides a custom design, they affirm that they own or have the legal right to use the design and agree to indemnify Stitch with Attitude against any copyright or trademark disputes.
- Customer grants Stitch with Attitude a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, and display any custom design, artwork, or idea provided by the Customer for the purposes of production, marketing, and portfolio display.
2. Payment & Order Processing
Full payment is required upfront before any custom design work or production begins. Orders will not be processed until payment is received in full
3. Design Approval & Production
- Prior to production, a digital mock-up of the design will be provided to the Customer for approval. It is the Customer’s responsibility to review the mock-up carefully for any errors (e.g., spelling, colors, placement, design accuracy).
- Once the Customer approves the mock-up, no further modifications can be made, and production will proceed as approved.
4. No Cancellations, Refunds, or Returns
- Due to the custom nature of these orders, all sales are final once the Customer has approved the mock-up.
- No cancellations, refunds, or returns will be accepted after approval, except in cases of defective or incorrect items due to an error on Stitch with Attitude’s part. Any such claims must be reported within 5 days of receiving the order.
5. Production & Shipping Timelines
- Estimated production and shipping times will be provided at the time of order, but they are subject to change based on order volume and material availability. Stitch with Attitude is not responsible for delays caused by third-party shipping carriers.
6. Limitation of Liability
- Stitch with Attitude is not responsible for any errors in the final product that were present in the approved mock-up.
- In the event of a dispute, Stitch with Attitude’s total liability shall not exceed the amount paid by the Customer for the specific custom order.
By completing a purchase, the Customer acknowledges that they have read, understood, and agreed to these terms.
